The Lagos State Special Offences Court in Ikeja on Monday admitted one of two extrajudicial statements made by Henry Omoile, co‑defendant in the ongoing trial of former Central Bank of Nigeria (CBN) Governor, Godwin Emefiele, over alleged $4.5 billion fraud.
The court, presided over by Justice Rahman Oshodi ruled that Omoile’s statement dated February 26, 2024, was voluntarily made without inducement, threat, or coercion, and therefore admissible as evidence.
The judge, however, rejected a second statement dated February 27, 2024, citing non‑compliance with Supreme Court guidelines, including the absence of video recording and lack of endorsement by Omoile’s lawyer.
Omoile had challenged the admissibility of both statements, alleging duress during interrogation by the Economic and Financial Crimes Commission (EFCC).
This prompted a trial within a trial to determine voluntariness. The February 26 statement, now marked Exhibits 1–3, was admitted after the court found no evidence of coercion.
Omoile is facing a three‑count charge of unlawful acceptance of gifts as an agent, while Emefiele is standing trial on 19 counts of alleged gratification and corrupt demands during his tenure as CBN Governor.
But both defendants had pleaded not guilty.
The case has been adjourned to June 26, June 30, and July 6 and 8, 2026, for continuation of the trial.
