Court Remands Two Men Over Alleged Smuggling of Arms Into Nigeria

A Federal High Court sitting in Ikoyi, Lagos, has ordered the remand of two suspects, Ejiogu Godson and Robert Eze, for 15 days in connection with the alleged smuggling of firearms and ammunition into the country.

The court, presided over by Justice Friday Ogazi, granted the remand order on Monday following an ex parte motion filed by the Nigeria Customs Service (NCS), allowing the agency sufficient time to conclude its ongoing investigation and prepare for the suspects' prosecution.

The motion, marked FHC/LAG/CR/601/2026, was presented by Mrs Kehinde Bode-Ayeni of the NCS Legal Services Department, Tin-Can Island Port. 

The application was anchored on Sections 294 and 295 of the Administration of Criminal Justice Act (ACJA) 2015, Section 6 of the Nigeria Customs Act 2023, and relevant constitutional provisions.

In her argument, the NCS counsel maintained that there is probable cause to detain the suspects while investigators pursue leads. The application was supported by a 15-paragraph affidavit from Customs operative N. Akpan, detailing the sequence of events that led to the arrests.

According to court documents, Customs officers placed Container Number TEMU 1845369 under surveillance starting July 8, 2026, based on credible intelligence. 

The container was said to have been physically examined on July 13, 2026, leading to the discovery of a cache of arms and ammunition cleverly concealed within the cargo.

Further inquiries resulted in the arrest of Godson and Eze. The affidavit alleged that the suspects have provided valuable information regarding other individuals involved in the forgery of Customs documents and the manipulation of import records.

The investigating officer noted that both suspects have made cautionary confessional statements. However, the NCS argued that the constitutionally mandated 24- to 48-hour detention period is insufficient due to the complexity of the case. 

Investigators are reportedly planning to travel to other jurisdictions to recover additional exhibits and apprehend other suspects currently at large.

The prosecution warned that releasing the suspects prematurely could jeopardise the ongoing operation.

After reviewing the submissions and evidence, Justice Ogazi ruled that the application held merit. The court granted the request to remand the duo at the Nigerian Correctional Service facility for 15 days.

The case has been adjourned until August 25, 2026, for the possible arraignment of the suspects.
