Dangote Refinery Wins Interim Order Against NUPENG, Truck Drivers’ Strike


The National Industrial Court sitting in Abuja has issued a seven-day interim injunction restraining the Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) and the Direct Trucking Company Drivers Association from embarking on a planned industrial action against the Dangote Petroleum Refinery.


Justice Emmanuel Danjuma Subilim granted the order following an ex parte application filed by the refinery’s counsel, George Ibrahim (SAN). 


The ruling also barred the unions from blocking public roads or disrupting operations at Dangote Refinery, MRS Oil Nigeria Plc, and MRS Oil and Gas Company Ltd.


The court held that the injunction was necessary to prevent irreparable harm to refinery operations and the public. 


Justice Subilim further directed that the unions be served within the week and ordered the case file to be reassigned to the court president, as the court’s vacation jurisdiction ends on September 23.


The order remains in effect pending the determination of a motion on notice.


Dangote Refinery had approached the court seeking to stop any action that could cripple its operations. 


It also requested an order compelling truck drivers to continue transporting petroleum products to its facilities and to the public.


In his submission, Ibrahim argued that the unions’ threats contravened Section 40 of the 1999 Constitution, which guarantees freedom of association, and Section 12(4) of the Trade Union Act.


Meanwhile, NUPENG accused the refinery of violating a recent resolution on workers’ rights and intimidating union leaders. 


The union said it has placed its members on red alert and called for government and civil society groups to intervene.


Dangote Refinery, in a statement, denied claims of monopoly, noting that over 30 other refinery licenses had been issued to private operators.
