Pointers are on the high side, that almost a month after Justice Akintunde Savage of the Lagos State High Court, Ikeja, issued a directive that the Chairman of Confidence Cargo, and Freight Forwarder, Dada Aigbe be committed to prison for being in contempt of the court, the said directive of the judge had allegedly not been executed by the Nigeria Police Force (NPF).
Justice Savage had on March 11, 2024, directed that Aigbe be committed to prison for a month until he purges himself of contempt.
The order of the judge was made upon the filing of forms 48 and 49 being a contempt proceeding instituted against Aigbe; an application which was filed and moved by one Mr Maruf Jimoh-Akogun, the counsel for the claimant, the judgment creditor in the suit designated ID/3831LMW/2016.
Justice Savage in his enrolment order held that “Mr Dada Aigbe is hereby committed to Kirikiri Maximum prison for a period of one month or until he purges himself of the contempt of this court and files an affidavit to henceforth not disobey this court or any court order.”
For Justice Savage's order to be executed, a Deputy Sheriff of the court had taken a “Request for Police Assistance” form dated March 18 to the Lagos State Commissioner of Police (CP) which was received the same day.
According to the form, the Deputy Sheriff had contended that “Under the provision of Section 11, Sheriff and Civil Procedure Cap 127, Laws of Lagos State, 1973, the police will be providing a constable to accompany the Sheriff to No 7a, Adeola Ajayi Crescent, Airport Road, Lagos State, to execute the warrant.”
It learnt from the claimant that after Aigbe was arrested by the police officers at the NAHCO Airport, he was handed over to the Officer-In-Charge of Crack Squad, CP Joel Ugowe, who allegedly released him contrary to the order of the court.
Contacted by Judiciary Correspondents who sought to know whether Aigbe had been handed over to the Kirikiri Maximum prison as ordered by Justice Savage, the Officer-In-Charge (Ugowe) had directed them to come to the Lagos Police Command as the issue was not a matter to be dealt with over the phone.
But on their arrival at the state police command on April 3, the journalists were informed by Ugowe that he was with the state's Commissioner of Police for over three hours and all attempts made by the reporters to see him proved abortive.
Jimoh-Akogun had maintained that the suspect was presently at his workplace at NAHCO Airport Road, in deviance from the order of the court.
The Judiciary reporters further communicated with the Lagos Public Relations Officer (PRO) of the Correctional Facility, Mr Rotimi Oladokun who explained that if the police had brought the suspect through the order of the court, it would have been documented in its office.
Oladokun equally suggested that he would check the office report to confirm.
But as of the time of filing this report, Oladokun had yet to confirm to the journalists whether Aigbe was detained in any correctional facility.
Jimoh-Akogun had on January 18 moved the committal to prison proceeding application in a case instituted by a traditional ruler, Oba Shakirudeen Adeshina-Kuti for themselves and on behalf of the Ajamogun/Onikotun family of Ewu kingdom.
The claimant had initiated the suit against the traditional ruler in Isolo, Oba Agbabiaka Orisedeko-Elemo and the Baale Mafoluku Ajao Estate, Chief Hussam Shekoni-Elemo as the first and second defendants respectively.
