Estate Of Efunroye Tinubu Threatens Contempt Suit Against Lagos CP, Other



The Attorney of Madam Iyalode Efunroye Tinubu's Estates, Akinfolabi Akindele, has issued a threat to institute contempt action against the Lagos State Commissioner of Police, alongside an old generation bank, over alleged disobedience to a court order. 


Akindele, who is an estate developer, stated this through his counsel, Idris Mohammed, just as he expressed dismay over the alleged action of the state government.


While positing that executive rascality should not be allowed in a democratic society, Akindele emphasised that the main suit relating to the controversial land is yet to be determined by the court, and it is in the interest of justice that parties should maintain status-quo antebellum as ordered by the court. 


According to Akindele, rather than for the CP and the old generation bank to adhere to good democratic principles by obeying the order of the court, they mobilised the state task force led by CSP Shola Jejeloye on the site in gross violation of the court.


It would be recalled that the High Court of Lagos State sitting in TBS, presided over by Justice Olukayode Ogunjobi, had directed parties in respect of disputed land at Lagoon View Development Scheme (Oju Olokun), Chevron Drive in Eti Osa Local Government Area of Lagos State, to maintain status-quo antebellum pending the determination of the suit.


The judge had equally directed that all construction on the disputed land measuring about 101.673 hectares should be stopped, and the defence parties should appear before the court to show why it should not grant all reliefs sought by the claimants.


Justice Ogunjobi’s order came sequel to an ex-parte application dated February 22, 2022, and filed before the court on behalf of Alhaji Shehu Adio Kassim Lumosa, and others, against the Lagos State Government and others.


Respondents in the suit include the State Governor, Babajide Sanwo-Olu, Attorney General and Commissioner For Justice, State Land Bureau, Lagos State Development and Property Corporation Limited (LSDPC).


Other respondents are First Bank of Nigeria, Nigeria National Petroleum Corporation Limited, NNPC, Asset Management Corporation of Nigeria (AMCON), Ontario Oil and Gas Limited, and Suntrust Savings and Loans Limited.


While appearing before the court on the memorandum of claims against the respondents in respect of the property which forms part of the Estate of Madam Iyalode Efunroye Tinubu, a Senior Advocate of Nigeria (SAN), Dr. Dada Awosika urged the court to grant the ex-parte application in the interest of justice.


Dr. Awosika further informed the court that his application is supported by 51 paragraph affidavit, exhibits, and a written address to show cause why the applications should be granted.


The parties were not present in court and didn’t have legal representation, despite proof that they were served.


In his ruling, Justice Ogunjobi held that having considered the depositions in the affidavit in support where the claimants averred that the eleven respondents have concluded arrangements to unjustly and illegally take possession of the disputed land, the court would grant the ex-parte.


The disputed land formed part of the land which Adam Akinfolabi Akindele of Adamakin Investment and Works Limited was entrusted with as the Attorney of the Estate of Madam Iyalode Efunroye Tinubu.
