Alleged Forged Medical Report: Kanu Slams N50 Billion Suit Against NMA

The leader of the proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu, has initiated a fresh legal action, suing the Nigerian Medical Association (NMA) for N50 billion in damages. 


The suit is based on the allegation that the NMA and its designated team tendered a forged medical report during his ongoing trial at the Federal High Court in Abuja.


The certified true copy of the suit, marked CV/4584/25, was dated and filed on November 12 and made available to journalists on Saturday by his counsel, Maxwell Opara.


In the action filed at the Abuja High Court, Kanu named the NMA, its president, Dr Bala Audi, and nine members of the medical team as defendants. 


The listed team members include Doctors Benjamin Egbon, Ajibare Adeola, Temitope Farombi, Sunday Owolade, Mustapha Salihu, Yarima Yusuf, Nwosu Ekeoma, Benjamin Olowojebutu, and Professor Emem Abraham.


Kanu’s statement of claim alleged malice, negligence, and professional misconduct against the defendants. 


He accused them of failing to perform the duty imposed on them by the trial court: to personally examine him and produce an independent medical report on his health and fitness to stand trial while in detention.


Kanu stated that the deterioration of his health during his trial led his counsel to submit a medical report to the trial court to secure bail or access to proper medical care. 


When the prosecution challenged the report’s authenticity, the Federal High Court ordered the NMA to constitute a committee for an independent examination.


The IPOB leader expressed shock that the defendants allegedly “forged, prepared and submitted a false medical report dated September 23” to Justice James Omotosho at the Federal High Court (FHC). 


He insisted that “This report is a fabrication, made without any medical examination or consultation” with him.


Kanu further claimed that the defendants acted in bad faith, reckless disregard, and gross dereliction of professional ethics, knowingly issuing a false and misleading document. 


He also accused them of conspiring “to pervert and in fact perverted the course of justice,” causing avoidable pain and injury to his person and reputation.


Beyond the N50 billion in damages, Kanu is seeking a court order compelling the NMA to immediately constitute and conduct a proper, independent medical examination by competent specialists who are not connected with the defendants in the current suit.


He urged the court to declare that the defendants' conduct constitutes a gross violation of his right to fair hearing and to the dignity of a human person, as guaranteed under Sections 34 and 36 of the 1999 Constitution (as amended).
