Globacom, Former CEO Face Criminal Charges Over Environmental Violations


The National Environmental Standards and Regulations Enforcement Agency (NESREA) has filed a criminal charge against Globacom Nigeria Limited and its former Chief Executive Officer, Mr Ahmad Farroukh, over alleged violations of installation regulations.

According to the charge sheet numbered FHC/L/967c/2024, NESREA is accusing Globacom and its former CEO of operating over 7,000 base transceiver stations nationwide without conducting an Environmental Audit or submitting the requisite Environmental Audit Reports for the years 2024 to 2027. 

The agency is further alleging that these actions contravene Section 5(2) of the National Environmental (Standards for Telecommunications and Broadcast Facilities) Regulations 2011, punishable under Section 1(1)(2) of the same regulations.

Additionally, the telecommunications giant and Mr Farroukh were charged with failing to comply with enforcement notices issued by NESREA on March 21, 2024. 

This alleged violation falls under Section 27(1)(b) of the National Environmental (Construction Sector) Regulations, 2011, which is punishable under Section 28(2) of the same regulation.

The prosecutor, Telnumun G. Maria, NESREA’s Director of Legal Services, is leading the case against the defendants. 

However, when the case was called for a hearing on February 20, 2025, neither the defendants nor their legal representatives were present in court. 

The prosecution was also absent. Consequently, the court adjourned the matter until May 8, 2025, for the defendants to take their plea.

The specific charges against Globacom and Mr Farroukh include operating telecommunications infrastructure without conducting the mandatory environmental assessment and disregarding enforcement notices served by the regulatory body.
