A Federal High Court sitting in Lagos has ordered the National Drug Law Enforcement Agency, NDLEA, to produce detained Lagos socialite and businessman, Afolabi Kazeem Michael, popularly known as KC Luxury, in court.
Justice Friday Ogazi gave the order after KC Luxury was allegedly detained for 14 days without being formally charged to court.
The judge also directed the anti-narcotics agency to file a response within five days to the fundamental rights enforcement suit challenging the continued detention of the social media influencer.
Justice Ogazi issued the directives while ruling on an Ex-parte application filed by KC Luxury through his counsel, Abdulakeem Labi-Lawal, SAN, under the Fundamental Rights (Enforcement Procedure) Rules 2009.
KC Luxury was allegedly arrested by NDLEA operatives on August 13, 2026, at the Murtala Muhammed International Airport, Lagos, while preparing to board a flight to Paris, France.
In the suit, his father, Eric Afolabi, who deposed to the affidavit on his behalf, alleged that his son has remained in NDLEA custody since his arrest without being informed of his offence or charged before a competent court.
After listening to the application, Justice Ogazi ordered that the NDLEA be served with the ex-parte motion, enrolled order and all accompanying processes within four working days.
The court further ordered the agency to file its response within five days of service and to produce the applicant in court on the next adjourned date.
The matter was adjourned to September 9, 2026, for hearing of the substantive originating motion.
The applicant argued that his continued detention beyond the constitutionally allowed period without charge violates his fundamental right to personal liberty as guaranteed under the 1999 Constitution (as amended).
In the substantive suit, KC Luxury is asking the court to declare his detention without formal charge unconstitutional, unlawful and a breach of his fundamental rights.
He is seeking an order for his immediate release or to be admitted to bail on liberal terms pending the filing of any charge.
He also alleged that NDLEA operatives searched his residence at Movamo Court, Banana Island, Lagos, without presenting a search warrant to him or his family, and that nothing incriminating was found during the search.
According to the affidavit, operatives seized his iPhone 15 and allegedly demanded the password under threat of bodily harm, despite the phone containing private information belonging to him and his wife.
KC Luxury further alleged that the agency took and circulated photographs and videos of him in custody, portraying him as a criminal before trial, thereby violating his rights to dignity and privacy.
Consequently, he is seeking N100 million damages for alleged publication of his photos/videos, N50 million for alleged unlawful arrest and detention, and N40 million for alleged invasion of privacy of his home and phone.
He is also asking the court to order NDLEA to return items allegedly seized from him, including €8,000, £3,000, a blue-strap Patek Philippe Nautilus wristwatch, an Audemars Piguet wristwatch with three bangles, a Hermès handbag, a Hermès Birkin travel bag, a Louis Vuitton travel box, an iPhone 15, a Lexus RX350 and a 2024 Toyota Hilux.
He claimed none of the items was acquired from proceeds of narcotics or any criminal activity.
The businessman further raised health concerns, stating that he suffers from acute and severe asthma and requires urgent medical care which cannot be provided at the detention facility.
He stated that he has a permanent address in Lagos, strong family and business ties, and is willing to surrender his international passport and meet any bail conditions.
The NDLEA, on its part, said the arrest followed an investigation into the interception of 184.50 kilograms of cocaine allegedly linked to an international trafficking network that uses Nigeria as a transit hub for shipments to the UK, Europe and Asia.
The agency said its investigation led to the seizure of foreign currencies, luxury items and searches connected to the suspect.
