A Federal High Court in Lagos has ordered the issuance of a bench warrant against a couple, Tunde Akobi and Rebecca Tayo Akobi, over allegations of obtaining money by false pretence and defrauding a woman of N87.4 million in a failed land transaction.
The order was made by Justice Ambrose Lewis-Allagoa following an ex parte application filed by the Force Criminal Investigation Department (FCID) Annex, Alagbon, Ikoyi, Lagos.
The motion, marked FHC/L/115c/2026, was moved by S.O. Ayodele, a legal officer with the FCID. Ayodele informed the court that the application was brought pursuant to Sections 113 and 114 of the Administration of Criminal Justice Act (ACJA) 2015, the Extradition Modification Order 2014, the Federal High Court Extradition Procedure Rules 2015, and the court’s inherent jurisdiction.
According to the prosecution, the application was supported by an affidavit deposed to by Chief Superintendent of Police (CSP) Omitosin Rotimi, the investigating police officer who led the inquiry into the alleged fraud.
In the affidavit, Rotimi stated that the office of the Assistant Inspector-General of Police, FCID Annex, Alagbon, received a petition alleging that the defendants obtained money under false pretences.
He further disclosed that the complainant, Mrs Nena Eunice Nwokoro, provided a statement to investigators confirming the allegations contained in the petition and submitted payment receipts relating to the disputed transaction.
The police officer told the court that investigations revealed that the defendants are believed to be residing in the United Kingdom.
He added that the INTERPOL Section of the FCID Annex is collaborating with the Federal Ministry of Justice to facilitate mutual legal assistance procedures aimed at repatriating the suspects to Nigeria for prosecution.
According to the affidavit, granting the application would enable law enforcement authorities to arrest the defendants and ensure their appearance before the court.
After considering the submissions of the prosecution, Justice Lewis-Allagoa granted the application and ordered that a bench warrant be issued against the couple.
According to the pending charges, the defendants allegedly obtained N87.4 million from Mrs Nwokoro in 2021 under the guise of selling land to her, a representation the prosecution claims they knew to be false.
The prosecution alleged that the defendants, alongside others currently at large, fraudulently induced the complainant to part with the money and subsequently converted the funds to their use.
The alleged offence of obtaining money by false pretence is said to be contrary to Section 1(1)(c) and punishable under Section 1(3) of the Advance Fee Fraud and Other Related Offences Act, 2006.
The defendants also face a separate charge of stealing the N87.4 million, an offence allegedly contrary to Section 383 and punishable under Section 390(9) of the Criminal Code Act, Laws of the Federation of Nigeria, 2004.
