AGF Takes Over Terrorism Prosecution of Predecessor Abubakar Malami, Son

ABUJA, NIGERIA — In a significant legal shift, the Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, SAN, has taken over the prosecution of his predecessor, Abubakar Malami, SAN, and his son, Abdulaziz.


The duo is facing a five-count charge bordering on terrorism financing and illegal possession of firearms, originally brought against them by the Department of State Services (DSS).


During proceedings at the Federal High Court in Abuja, the Director of Public Prosecution of the Federation (DPPF), Rotimi Oyedepo, SAN, informed Justice Joyce Abdulmalik that the case file had been formally transmitted from the DSS to the AGF’s office.



“My lord, I was informed by counsel to the DSS that the case file has been transmitted to the office of the Attorney General of the Federation,” Oyedepo stated.

 

The DPPF requested an adjournment to allow the AGF to review the evidence and determine the next course of action. 


While the defence team, led by Adedayo Adedeji, SAN, did not oppose the delay, they cautioned that they would move to strike out the charges if the trial failed to proceed at the next hearing.


The charges against the former Chief Law Officer are gravity-laden. According to charge sheet FHC/ABJ/CR/63/2026, Malami is accused of refusing to prosecute suspected terrorism financiers despite receiving their case files during his tenure, warehousing a Sturm Magnum 17-0101 firearm and dozens of live and expended cartridges at his residence in Birnin Kebbi, Kebbi State, without lawful authority.


Despite being granted bail in the sum of N200 million each at a previous hearing, Malami and his son remain at the Kuje Correctional Centre pending the perfection of their release terms.


To secure their freedom, the court requires two sureties each, owning landed property in Abuja's elite Maitama or Asokoro districts, deposition of property titles and international passports with the court, recent passport photographs and an affidavit of means from all sureties.



Justice Abdulmalik adjourned the matter until March 10, 2026, for the commencement of the trial.
