Justice Ibironke Harrison of the Lagos State High Court, Tafawa Balewa Square (TBS), has ordered the arrest of Access Bank, its acting Managing Director, Bolaji Agbede, and three other defendants for failing to appear for their arraignment.
The bench warrant also applies to Balmoral International Limited, DDSS International Company Limited, and Adejare Adegbenro.
The defendants are facing a four-count charge filed by the Lagos State Government, including conspiracy, stealing, and attempted theft.
During the resumed hearing on the case, the Lagos State prosecution counsel, Uthman Rilwan, informed the court that notices of arraignment had been duly served on all defendants, yet they failed to attend.
The prosecutor urged the court to issue an arrest warrant to ensure their appearance in subsequent proceedings.
According to the charge, on or about September 2, 2013, at Plot 1261, Adeola Hopewell Street, Victoria Island, Lagos, the defendants conspired to commit theft.
Specifically, they are accused of stealing property belonging to MOB Integrated Services, located at Plot 40b, Bourdillon Road, Ikoyi, Lagos.
The prosecution claimed the defendants used the property as collateral for a loan without the owner’s consent, leading to a consent judgment.
Additionally, the defendants are accused of attempting to steal the same property on May 26, 2019, by granting DDSS International Company Limited a credit facility of ₦1 billion.
The alleged offences violate Sections 411, 280, and 21 of the Criminal Laws of Lagos State 2011.
Justice Harrison, in response to the prosecutor's submission, issued a bench warrant against the second to fifth defendants, including the principal officers of Access Bank and the two companies.
She directed law enforcement to execute the warrant and ensure the defendants appear in court.
The case has been adjourned to February 24, 2025, for arraignment.
