It would be recalled that the applicant, Prince Adewale Adeyemi Abdul Rauf Oniwonlu, through his lawyer, R. O. Oshodi, had approached the court for the mandatory injunction against the respondents, on the ground that the first to third were aware of the pendency of the suit, before going ahead and installed Chief Waliu Rasaki Olasunkanmi, aka Rasaq Oluwo, as Oba of Ibeju-lekki.
In her ruling, Justice Dawodu, after entertaining counsel’s arguments, held that “The first to third defendants had been served and were aware of the pendency of the suit before they went ahead with the installation.”
The judge equally declared that the sanctity of the court must be preserved.
While adjourning until February 14, 2024, for the hearing of the substantive suit, Justice Dawodu restrained the monarch from parading himself as Oba of Ibeju-lekki, until the hearing and determination of the suit.
