Real Estate Dispute: Lagos Woman Sues Redbrick Homes for alleged N19M Extortion, Contract Violations

Lagos, Nigeria
– A Lagos-based businesswoman, Mrs Oladapo Agoro, has filed a lawsuit against Redbrick Homes International Limited, a real estate development company, alleging a serious breach of contract, extortion, and a campaign of harassment over a property in the upscale Amen Estate, Ibeju Lekki.

In a statement of claim filed before a Lagos High Court sitting in Ajah by her lawyer, Olanrewaju Ayanwale, Mrs Agoro details a series of disputes stemming from a 2018 sub-lease agreement.

According to the claim, she was assigned Plots 5 & 6 in Amen Estate and subsequently contracted Redbrick Homes to develop the land into four wings of 3-bedroom terrace houses with staff quarters, with the addition that the project was intended to last two years, with the claimant making payments in instalments.

However, after paying over 50% of the agreed sum, the defendant allegedly began introducing what the claimant describes as strange terms and conditions.

In the court papers, it was argued that on June 1, 2021, Redbrick Homes issued a circular to homeowners announcing a cost review due to inflation.

The document noted that despite the claimant's contract already having an inflation adjustment clause, her outstanding building cost was unilaterally increased by 40%.

However, when she resisted, the defendant, through its representative, Mrs Folasade Gbadamosi, allegedly threatened to halt construction and prevent any other contractor from accessing the estate to complete the work.

Fearing her property would be seized due to the defendant's control over estate access, Mrs Agoro claimed she was advised to pay an additional N15 million to continue the project, bringing the total extra cost, including a N4 million mediation fee, to N19 million.

The claim further alleged that upon completion, the buildings were shoddily built and poorly finished, rendering them unfit for human habitation.

Despite presenting video evidence of the poor workmanship, the defendant allegedly refused to remedy the situation or refund the cost of repairs.

The dispute escalated recently when Redbrick Homes demanded N90 million from Mrs Agoro as a mandatory contribution towards a proposed gas turbine project in the estate.

The claimant, who had already installed solar panels, refused the demand, pointing to a notice that described the payment as optional. She claims the demand is a pretext to declare her in default and seize her properties.

Further allegations include the defendant preventing her tenant from entering the estate over the disputed payments and an incident where the defendant's security personnel were allegedly caught breaking into her property, stealing expensive cables, and causing damage.

The claimant also stated that a police report was filed at Zone 2, Onikan, regarding the N19 million extortion.

She alleged the defendant's Managing Director has repeatedly refused to honour police invitations, falsely claiming to be out of the country, and that the police have received over 10 similar complaints against her.

Mrs Agoro is now seeking legal redress. Her claims against Redbrick Homes International Limited include: A declaration that the defendant breached the building contract, a declaration that all extraneous charges are illegal and unenforceable, an order for full restitution of all proven monetary losses, an order of perpetual injunction restraining the defendant from barring access to her premises or levying illegal charges, general damages for breach of contract, pre-judgment interest of 20% on the judgment sum, and N5 million for the cost of the action.
