Industrial Showdown: PENGASSAN, NNPCL, Others Accused of Evading Court Order Stopping Dangote Refinery Strike

The Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN), the Nigeria National Petroleum Company Ltd (NNPCL), the Nigeria Midstream and Downstream Petroleum (NDMP), and the Nigeria Upstream Petroleum Regulatory Commission (NUPRC) are reportedly evading the service of a court order restraining them from their planned industrial action against Dangote Petroleum Refinery and Petrochemicals FZE.


The restraining order was secured on Monday by George Ibrahim, a Senior Advocate of Nigeria (SAN), following an application argued on behalf of the refinery.


Justice Emmanuel Danjuma Subilim held that the continuation of the strike would irreparably damage the refinery's business and cripple the provision of essential services to the Nigerian public, thus determining that the balance of convenience was in favour of the Applicant.


The court ruled that restraining the defendants was necessary to preserve industrial peace and aid the continuous provision of essential services.


The order specifically barred the defendants from cutting crude and gas supply to Dangote Refinery. 


It also restrained them from blocking roads, obstructing vehicular movement, shutting down operations, or in any way frustrating the claimant's activities, pending the determination of the motion on notice.


The court directed that the restraining order and motion on notice be served on all defendants. 


However, lead counsel for Dangote Refinery, James Onoja (SAN), disclosed that “all efforts to serve the Court Order on the defendants proved abortive, as they claimed to be on strike.”
