Obaship Battle Continues: Igbogbo Royal Stool Case Heads Back to Court in October

The protracted legal battle over the Igbogbo obaship stool in Ikorodu is set to enter a critical phase, as a Lagos High Court, sitting in the Ikorodu Judicial Division, has reserved October 14 for hearing in the long-running dispute. 


Justice Iyabo Akinkugbe adjourned the case after listening to submissions from legal counsels representing all parties involved.


The dispute, which originated in 2015, centers around the rightful ascension to the Oba of Igbogbo throne. 


The claimants in the suit, designated IKD/1162GCMW/2015, are Mrs Oyindamola Osho-Ojuba, Mr Olusanya Adeyemi Osho-Ojuba, Mr Sakiru Odufuwa Osho-Ojuba, Alhaja Karimotu Talabi, and Mr Rasaq Ero Osho-Ojuba. 






They appear both in their individual capacities and as representatives of the Ijaolu-Osho-Ojuba Ruling House of Igbogbo, Lagos State.


Named as respondents in the suit are the Lagos State Government, the Lagos State Attorney General and Commissioner for Justice, the Lagos State Commissioner for Local Government and Chieftaincy Affairs, the Executive Secretary of Igbogbo/Baiyeku Local Council Development Area, and Chief Tajudeen Onasanya (Odofin Of Igbogbo). 


Others include Chief Ganiu Omotayo, Alhaji Nasirudeen Oyekande, and Alhaji Kolawole Jubril. The complexity of the case has been compounded by numerous judicial changes. 


The matter has seen multiple judges preside over it due to transfers and administrative reassignments since its inception. 


Notably, Justice Akintunde Savage, who initially handled the case, was transferred to the Ikeja Division, necessitating the re-assignment of the file by the Chief Judge of Lagos State to a judge within the Ikorodu jurisdiction.


A significant point of contention raised by the claimant's counsel, Mr M.O. Ishola, is an alleged disobedience of a court injunction issued on April 19, 2016. 


Ishola informed the court that despite this injunction, the monarch and the chiefs of Adeboruwa Oba-in-Council proceeded to nominate an Oba.

Earlier in the proceedings, in 2016, Justice Savage had ruled that the Chairman, Council of Kingmakers of Igbogbo, Ikorodu, was a juristic person known to law and could be sued in the case. 


This ruling was in response to an application by some respondents seeking to strike out the chairman's name on the grounds that the title lacked juristic personality.


The core of the claimants' plea is a declaration from the court that directives issued by the Chairman, Council of Kingmakers, to other respondents for forwarding a candidate's name for approval and appointment were unlawful and violated the Obas and Chiefs Law of Lagos State. 


Furthermore, they seek a declaration that it is unequivocally the turn of the Ijaolu (Osho-Ojuba) ruling house to present a candidate for the vacant stool, and a mandatory injunction compelling the fifth respondent to accept and approve their nominated candidate.
