Court Denies Trump’s Request to Delay Sentencing in Hush-Money Case

The Court of Appeal in New York, led by Justice Ellen Gesmer, has rejected President-elect Donald Trump’s bid to postpone his sentencing in the high-profile hush-money case.

Trump was convicted in May 2024 on 34 counts of falsifying business records related to a $130,000 payment to adult film actress Stormy Daniels during the 2016 presidential campaign.

Trump’s legal team argued for a delay, citing his status as President-elect and claiming immunity from prosecution should extend to him.

Justice Gesmer dismissed the motion, stating, “After consideration of the papers submitted and the extensive oral argument, the movant’s application for an interim stay is denied.”

The sentencing, scheduled for Friday, January 10, 2025, will determine Trump’s punishment.

Although he faces up to four years in prison, Judge Juan Merchan, who presided over the trial, has signalled a likelihood of an unconditional discharge, ruling out jail time.

Trump, set to be sworn in for a second presidential term on January 20, 2025, will enter office as a convicted felon, an unprecedented development in U.S. history.
