In a significant move to address the challenges of overcrowded correctional facilities and advance justice sector reforms, Governor Babajide Sanwo-Olu has authorized the release of 55 inmates across Lagos State.
The release, approved on October 15, 2024, follows the recommendations of the Lagos State Advisory Council on the Prerogative of Mercy.
Under the governor’s directive, 40 of the inmates are to be released immediately, while the remaining individuals will serve an additional three to six months before their release.
This decision is grounded in the constitutional authority vested in the governor by Section 212 (1) & (2) of the 1999 Constitution of the Federal Republic of Nigeria (as amended), which grants the governor powers to exercise clemency in certain cases.
According to the statement signed by Mr Lawal Pedro, SAN, the Lagos State Attorney General and Commissioner for Justice, the release orders will be executed following the completion of administrative processes within the correctional facilities.
“Governor Sanwo-Olu’s decision aligns with his commitment to decongest correctional facilities as part of broader justice sector reforms in Lagos State.
“By alleviating the burden on these facilities, the government aims to improve living conditions for inmates and ensure that resources within the justice system are efficiently utilized.
“The Advisory Council on the Prerogative of Mercy conducted a thorough review process in making its recommendations.
“Each application for clemency was carefully evaluated based on multiple factors, including the nature of the offence, duration of incarceration, age, health condition, and the conduct of the inmate during their time in custody.
“Information provided by correctional authorities played a crucial role in assessing each case”, the statement added.
