Justice Ibironke Harrison of the Lagos High Court, Tafawa Balewa Square, today fixed April 3, 2023, to hand down her ruling on the no-case submission filed by the suspended Assistant Superintendent of Police, ASP, Drambi Vandi, who allegedly killed a Lagos-based lawyer, Omobolanle Raheem, on December 25.
The judge arrived at the date after the defence lawyer, Adetokunbo Odutola, adopted his final written address on the no-case submission filed on February 20, 2023, wherein he is asking the court to dismiss the charge claiming that he has no case to answer.
Adopting his final written address on the no-case submission, Odutola prayed the court to dismiss the suit and discharge the defendant, claiming that he has no case to answer on the reason that the ballistic report of the gun did not match with the bullet that was shot.
Odutola also argued that the pathologist who testified mentioned that the bullet penetrated from the left through the armpit, while the prosecution stated that the deceased was shot in the chest.
The prosecution, led by the Attorney General, AG, of Lagos State, Moyosore Onigbanjo, SAN, countered the arguments and urged that the defendant come up to defend himself in the case.
It would be recalled that the defendant is standing trial on a count of murder brought against him by the Lagos State government contrary to Section 223 of the Criminal Law of Lagos State, 2015 for allegedly killing a female lawyer.
