Fundamental Rights Action Initiated Against Nigeria Police Force, Others Over Alleged Threat To Life



The Nigeria Police Force has been dragged before Justice M. A. Salvage of the High Court of Lagos State in Ikeja over an alleged threat to the life of an engineer, Samuel Oladele.


The fundamental rights suit, initiated by the engineer, is therefore expected to be heard on February 28, 2023.


The engineer, who approached the court to seek justice over an alleged threat to his life by suspected land grabbers, posited that there was a persistent threat to his life based on an alleged frivolous petition from the suspects, who encroached on his land.


The police had charged the engineer to court consequent upon a petition by Sule Suraju (Aro of Abuleado) and Taye Hassan (Alias Taye Burger), but the case was later struck out lacking diligent prosecution.


It learned that the police thereafter went to the site and arrested Oladele’s worker and seized his vehicle in a bid to get him arrested again.


But the engineer in the suit designated ID/14897/MFHR/2023, through his lawyer, Adetayo Bello, is praying to the court to stop his harassment and intimidation.


Respondents in the suit are the Inspector general of Police, Commissioner of Police (General Investigation Section ‘D’ Department), Sheik M. Danko, and Officer-in-Charge Team “C” of General Investigation Section D ‘Department, (Force CIID) Annex, Alagbon Close, Ikoyi, Lagos.


The fourth and fifth respondents are Sule Suraju (Aro of Abuleado) and Taye Hassan (Alias Taye Burger).


Oladele is specifically urging the court to declare his continued invitation, harassment, and intimidation by the police, particularly the third respondent at the instance of the fourth and fifth respondents, unlawful, illegal or unconstitutional.


The engineer is further asking Justice Salvage to hold that the crux of the dispute between him and the fourth and fifth respondents is a land matter which is civil and does not fall within the purview of cases and matters the police can adjudicate on.


Oladele is equally asking the court for an order that he is entitled to his dignity and freedom, and coercion to transfer his title of the land on Samuel Oladele Ahmed layout, Sixth Avenue Extension, off Lagos/Badagry Express Road, Amuwo Odofin, to the fourth and fifth respondents is illegal and unlawful.


The engineer is further urging the judge for an order of perpetual injunction restricting the first, second, and third respondents “either by themselves or through their officers, agents, privies, or however called from further inviting, harassing, intimidating ‘and coercing the applicant to transfer his title without just cause.”
