The High Court of Lagos State in Osborne, Ikoyi, on Tuesday, ordered the Assistant Inspector General of Police, AIG, Force Criminal Investigation Department (ForceCID Annex), Alagbon, Lagos, to produce an alleged fraudster, Bamise Samson Ajetunmobi, a judgment debtor to the sum of N15,541, 350 billion, before the court on February 2, 2023.
The directive was issued by the court, presided over by Justice Taofiqat Oyekan-Abdullahi, while granting a Motion Exparte filed and argued by Adetunji Adedoyin-Adeniyi, counsel to 17 applicants in the suit designated LD/579CM/2021.
Applicants/judgment creditors in the suit are: Olabode Olanipekun; Segun Animashaun; Mrs. Abioye Idris; Mrs. Erhi Ojoboh; Mrs. Laurel Onumonu; Mr. Olarenwaju Aderounmu; Mr. Edet Udo; Chikezie Nwokoch; Dr. Onyekachi; Mrs. Aderonke Salami; Mr. Kolade Stephen Hambolu; Mr. Moran Mario Malik; Grantiff Investment Limited; Afrinvest Asset Management Limited; Global Stonecrest Bureau De Change; Hollandpark Bureau De Change and Alstom Matrix Limited.
Others include Mrs. Catherine D. Kelechi-Onyeocha; Kehinde Coker; Unyime Faithlyn Akinmade; Francis Ekechi; Grant Olamire; Olajide Ahmed; Paelyt Solutions Limited; Quadri Aderogba; Yisau Ibitola and Omowunmi Elebute.
While the respondents/judgment debtors are: Imagine Global Holding Company Limited; Imagine Global Solutions Limited; Mr. Bamise Samson Ajetunmobi; Mrs. Elizabeth Anuoluwapo Ajetunmobi; Assistant Inspector General Of Police FCIID, Alagbon, Lagos, and Inspector Aliyu {IPO}.
It would be recalled that Adedoyin-Adeniyi had approached the court for “an order for leave of the Honourable Court for the Issuance of Judgment Summons to compel the 3rd Judgment Debtor to appear before this Honourable Court and be examined on Oath as to his means, having disobeyed the Order of this Honourable Court to pay the Judgment Sum of N15, 541, 350, 000.00 Billion, to the 1st-17th Judgment Creditors pursuant to the judgment of the court delivered on July 14, 2022.
“An order of the Honourable Court for the Issuance of Judgment Summons against the 3rd Judgment Debtor, compelling him to appear before the Court and be examined on Oath as to his means, having disobeyed the Order of this Honourable Court to pay the Judgment Sum of N15,541,350,000.00 billion, to the 1st-17th Judgment Creditors, pursuant to the judgment of this Honourable Court delivered on July 14, 2022.
“An order of the court directing, compelling, and commanding the Assistant Inspector-General Of Police FCIID, Alagbon, Lagos and Inspector Aliyu (IPO), the Commissioner of Police, Lagos State, their deputies, assistants and all other officers under their command, control, and supervision to produce the third Judgment Debtor; Mr. Bamise Samson, who is currently in their custody to answer the Judgment Summons issued by the court, for having disobeyed the Order of this Honourable Court to pay the Judgment Sum of N15,541,350,000.00 billion, to the 1st-17th Judgment Creditors pursuant to the Judgment of this Honourable Court delivered on July 14, 2022.”
Adeniyi-Adedoyin had informed the court that the orders sought were pursuant to Sections 55 and 58 of the Sheriffs & Civil Process Act; Order X Rule 1 of the judgment Enforcement Rules and under the court’s inherent jurisdiction.
After entertaining arguments from the lawyer to the judgment creditors, Justice Oyekan-Abdullahi held that; “leave be and same is hereby granted to the Judgment Creditor/Applicants for the issuance of Judgment Summons to compel the 3rd Judgment Debtor to appear before this Honourable Court and be examined on Oath as to his means, having disobeyed the Order of this Honourable Court to pay the Judgment Sum of N15, 541, 350, 000.00 (Fifteen Billion, Five Hundred and Forty-One Million, Three Hundred and Fifty Thousand Naira Only to the 1st– 17th Judgment Creditors pursuant to the judgment of this Honourable Court delivered on the 14th July 2022.
“That leave be and same is hereby granted to the Judgment creditor/Applicants for the Issuance of Judgment Summons against the third Judgment Debtor, compelling him to appear before this Honourable Court and be examined on Oath as to his means, having disobeyed the Order of this Honourable Court to pay the Judgment Sum of N15,541,350,000.00 (Fifteen Billion, Five Hundred and Forty-One Million, Three A Hundred and Fifty Thousand Naira Only to the 1st-17th Judgment Creditors pursuant to the Judgment of this Honourable Court delivered on the 14th July 2022.
“That leave be and same is hereby granted to the Judgment Creditor/ Applicants directing, compelling and commanding the Assistant Inspector General Of Police FCIID, Alagbon, Lagos and Inspector Aliyu {IPO}, the Commissioner of Police, Lagos State, their deputies, assistants and All other officers under their command, control, and supervision to produce the 3rd Judgment Debtor, Mr. Bamise Samson, who is currently in their custody, to answer the Judgment Summons issued by this Honourable Court, for having disobeyed the Order of this Honourable Court to pay the Judgment Sum of N15,541,350,000.00 (Fifteen Billion, Five Hundred and Forty-One Million, Three Hundred and Fifty Thousand Naira Only) to the 1st-17th Judgment Creditors, pursuant to the Judgment of this Honourable Court delivered on the 14th July 2022.
“That the 3rd Judgment Debtor shall be produced in this Court on the 2nd of February, 2023 at 12noon.”
