Justice Oluwatoyin Taiwo of a Special Offences Court sitting in Ikeja on Wednesday fixed September 19, 2022, as the day to rule on the bail application filed by convicted Nollywood star, olanrewaju James, also known as ‘Baba Ijesha’.
The court fixed the date after entertaining arguments of both the prosecuting and defence counsels on whether the convict has met special circumstances for him to be granted bail by the court.
It is recalled that two months after Justice Taiwo convicted and sentenced ‘Baba Ijesha’ to serve a five-year-jail-term, which is to run concurrently, his legal team had headed to the Lagos Division of the Court of Appeal to question the lower court’s decision.
In his argument on the bail application, the lawyer for the convicted Nollywood actor, Chukwudi Adiukwu, explained that the bail application was brought pending an Appeal for the convicted ‘Baba Ijesha’ to be admitted to bail either unconditionally or upon reasonable conditions.
The defence counsel equally revealed that the bail application was brought before the lower court, as getting a date at the Appeal Court might be difficult, considering the number of cases before the appellate court.
Adiukwu contended that with the prison calendar, the convict would have served his five years concurrent jail term within 3 years and 6 months before the hearing might take place at the Appeal Court.
While adding that ‘Baba Ijesha’ was of good conduct before the lower court during his trial, and was never absent until judgment was delivered, the defence lawyer urged the court to consider the special circumstances in granting bail to the convicted actor.
Reacting, counsel for the prosecution, Omowunmi Bajulaye-Bishi, said Adiukwu in his address failed to establish the special circumstances which may warrant ‘Baba Ijesha’ being granted bail.
Bajulaye-Bishi asked the court to refuse the application of the convicted Nollywood actor.
