Custody Battle Takes Dark Turn: Woman to Be Arrested for Allegedly Falsifying Sexual Abuse Claims

A Lagos High Court has issued a bench warrant for the arrest of Rahmat Omolara Animashaun, following allegations that she made false accusations of sexual assault against her ex-husband, involving their two young children.

The order comes after the Directorate of Public Prosecutions (DPP) of the Lagos State Ministry of Justice recommended her prosecution for multiple criminal offences.

Justice I.O. Harrison of the Lagos State High Court issued the bench warrant on July 9, 2025, after Ms. Animashaun failed to appear in court for a pending criminal case, marked LD/25997C/25, filed by the State of Lagos.

According to the DPP’s legal advice, Ms. Animashaun is facing charges of perjury, bringing false accusations, making false statements to a public officer with Intent, and attempting to pervert justice.

These offences, according to the prosecution, are punishable under Sections 86, 95, 96, and 97(3) of the Lagos State Criminal Law, Chapter C17, Volume 3, Laws of Lagos State, 2015.

The core of the matter stems from a contentious custody battle between Ms. Animashaun and her ex-husband, Mr Adewale Olatunji, following their divorce.

The couple shared joint custody of their two children, a boy and a girl.

The allegations first surfaced on October 16, 2022, when Ms. Animashaun claimed that the children returned from their father’s home appearing "pale and sickly."

Rahmat Omolara Animashaun,

Suspecting sexual abuse, she reportedly took them to the Mirabel Centre, a forensic medical facility, for examination.

Initial tests at the Mirabel Centre purportedly indicated signs of sexual assault.

However, Mr Olatunji denied the allegations and sought further medical evaluation for the children.

This led to follow-up examinations at the Police Cottage Hospital, where medical personnel were unable to confirm any sexual abuse.

The attending doctors recommended specialist reviews for both children, scheduled for November 17, 2022.

Crucially, Ms. Animashaun allegedly failed to present the children for these crucial specialist examinations on the scheduled date.

The children were not taken for the recommended reviews until February 7, 2025, a significant delay of over two years, at the National Hospital, Abuja.

The examinations conducted by Dr Ukpai Nwankwo Ukpai at the National Hospital ultimately declared both children healthy.

Based on the totality of these medical reports and the investigative findings, the Directorate of Public Prosecutions concluded that Ms. Animashaun deliberately made false accusations with the intent to implicate her ex-husband and obstruct justice.

The DPP's legal advice cited key precedents, including Kayode Odukoya v. FRN (2023) for establishing perjury, Alhaji Moshood Aroyewun v. Commissioner of Police, Ogun State (2004) for false statements to public officers, and Joseph Nwobike (SAN) v. FRN (2019) on attempts to pervert justice.

According to the DPP, “The conduct of the suspect was less than honest and honourable,” asserting that the allegations, when weighed against the evidence, including the delayed medical evaluations and negative forensic findings, strongly suggested a deliberate attempt to mislead authorities and damage Mr Olatunji’s reputation.
